22 SP 9 NOTICE OF FORECLOSURE SALE NORTH CAROLINA, ASHE COUNTY Under and by virtue of a Power of Sale contained in that certain Deed of Trust executed by Rachel L Robbins and Matthew Robbins to Robey C. Best Jr., Trustee(s), which was dated October 17, 2017 and recorded on October 17, 2017 in Book 485 at Page 585 and rerecorded/modified/corrected on October 19, 2017 in Book 485, Page 767 and rerecorded/modified/correcte on October 25, 2017 in Book 485, Page 1262, Ashe County Registry, North Carolina. Default having been made of the note thereby secured by the said Deed of Trust and the undersigned, Trustee Services of Carolina, LLC, having been substituted as Trustee in said Deed of Trust, and the holder of the note evidencing said default having directed that the Deed of Trust be foreclosed, the undersigned Substitute Trustee will offer for sale at the courthouse door of the county courthouse where the property is located, or the usual and customary location at the county courthouse for conducting the sale on JUNE 1, 2022 AT 11:00 AM, and will sell to the highest bidder for cash the following described property situated in Ashe County, North Carolina, to wit: Being a tract of land located in Obids Township, Ashe County, North Carolina, bounded by the lands, formerly or in possession of, the following: on the west and north by Kyle Blackburn and on the southeast by NCSR #1164, and being more particularly described as follows: Beginning on a point in the centerline of NCSR #1164, said point being the most southwestern corner of the Joseph Donald Russell and wife, Cathy S. Russell property (Book 175, Page 2186) and a southeastern corner in the line of the Kyle Blackburn and Wife, Allene Blackburn property Book 131, page 1259), said beginning point being located S 15 degrees 49’ 59” E 117.04 feet from the southwest corner of a one-story brick-veneer dwelling located on the said Joseph Donald Russell property; thence running with the Russell-Blackburn line, N 30 degrees 01’ 58” W, crossing an existing 1/2” rebar at 22.42 feet, for a total distance of 167.13 feet to an existing axle, N 70 degrees 29’ 30” E, crossing an existing ¾” iron pin at 219.67 feet, for a total distance of 249.55 feet to a point in the centerline of NCSR #1164; thence running with the centerline of said road the following four calls: 1) S 14 degrees 16’ 55” W 38.23 feet, 2) S 24 degrees 52’ 03” W 38.85 feet, 3) S 34 degrees 39’ 58” W 43.98 feet, 4) S 40 degrees 07’ 50” W 156.38 feet to the point of Beginning, containing 0.539 acre, inclusive of the existing right of way of NCSR #1164. According to a survey by Billy W. Barr, RLS L-3174, dated 9/8/92. Save and except any releases, deeds of release or prior conveyances of record. This sale is made subject to all prior liens, unpaid taxes, any unpaid land transfer taxes, special assessments, easements, rights of way, deeds of release, and any other encumbrances or exceptions of record. To the best of the knowledge and belief of the undersigned, the current owner(s) of the property is/are Rachel L. Robbins. An Order for possession of the property may be issued pursuant to G.S. 45-21.29 in favor of the purchaser and against the party or parties in possession by the clerk of superior court of the county in which the property is sold. Any person who occupies the property pursuant to a rental agreement entered into or renewed on or after October 1, 2007, may, after receiving the notice of sale, terminate the rental agreement by providing written notice of termination to the landlord, to be effective on a date stated in the notice that is at least 10 days, but no more than 90 days, after the sale date contained in the notice of sale, provided that the mortgagor has not cured the default at the time the tenant provides the notice of termination [NCGS § 45-21.16A(b)(2)]. Upon termination of a rental agreement, the tenant is liable for rent due under the rental agreement prorated to the effective date of the termination. If the trustee is unable to convey title to this property for any reason, the sole remedy of the purchaser is the return of the deposit. Reasons of such inability to convey include, but are not limited to, the filing of a bankruptcy petition prior to the confirmation of the sale and reinstatement of the loan without the knowledge of the trustee. If the validity of the sale is challenged by any party, the trustee, in their sole discretion, if they believe the challenge to have merit, may request the court to declare the sale to be void and return the deposit.
